Final Release Time for Golf Carts
Breakfast Hill Golf Club enforces a strict final cart release time of 4.5 hours prior to sunset for 18-holes and 2.5 hours prior to sunset for nine-holes.
Assumption of Risk
As with other outdoor recreational activities, there are certain inherent risks associated with the sport of golf. These risks include, but are not limited to, being struck by errant balls, being struck by lightning, injuries associated with the improper operation of golf carts, and potential slips, trips and falls associated with wet or uneven walking/playing surfaces.
By playing Breakfast Hill Golf Club players agree to assume these risks in their entirety and agree to hold harmless the golf course, including its owners, employees, and representatives, for any associated accidental injury, illness, death, or personal property damage.
Covid-19 Warning
Breakfast Hill Golf Club has taken enhanced health and safety measures for Members, our Guests, and our staff members. Everyone must follow all posted instructions while visiting Breakfast Hill Golf Club. An inherent risk of exposure to Covid-19 exists in any public place where people are present. Covid-19isanextremelycontagiousdiseasethatcanleadtosevereillnessanddeath. According to the Centers for Disease Control and Prevention, senior citizens and Guests with underlying medical conditions are especially vulnerable. By visiting Breakfast Hill Golf Club you voluntarily assume all risks related to exposure to Covid-19.
On-Course, Non-Player, & Child Safety Policies
Breakfast Hill Golf Club, LLC’s policy for children (ages eight and under) and non-playing adults on-course is as follows:
To be allowed on-course, a CHILD must be accompanied by an adult and is playing golf with said adult. The child must show a set of clubs and all applicable greens fees apply. The adult always assumes responsibility for their child’s behavior on-course. Toy plastic clubs are not considered valid equipment and are not permitted on-course.
Babies and/or toddlers in strollers, backpacks, or other child carriers are not allowed on-course or on the driving range tee surface. Children on property by the clubhouse and surrounding areas must be always monitored by an adult. Management will address any unruly behavior by the child to the adult. This is for the safety of the child and the benefit of other guests. This may include, but not limited to climbing on patio walls, running around recklessly, throwing items, jumping into golf carts, and harassing other guests.
ADULTS who would like to accompany a golfer on-course must do so in a golf cart and pay all applicable cart rental fees. While on-course they assume all risks as outlined in Breakfast Hill Golf Club, LLC’s Assumption of Risk policy. Even if the golfer is walking the course, the non-golfer must be in a cart.
Golf Cart Waiver, Release of Claims, & Indemnification Agreement
By tendering your green fee transaction and operating a golf cart at Breakfast Hill Golf Club you are opting into this Golf Cart Waiver, Release of Claims, & Indemnification Agreement. You hereby understand and acknowledge the following terms of said Agreement:
I understand that it is my sole responsibility to become familiar with the use and operation of the golf cart and agree that I will not attempt to operate the golf cart unless I am completely familiar and comfortable with the operations. I agree to abide by all rules and regulations associated with use of the golf cart and will ensure that my passenger(s) comply with all applicable rules and regulations. I further understand and appreciate that upon request assistance and/or clarification on use of the golf cart from the Breakfast Hill Golf Club staff.
I agree to always operate the golf cart in a safe and courteous manner at Breakfast Hill Golf Club. I agree to be responsible for any or all damages and replacement costs for the golf cart and any other rented golfing equipment. I also agree to the following golf cart rules and regulations:
- Golf cart operator must be a minimum of 18 years of age and must have a valid Driver’s License.
- Golf carts must be operated properly. Horseplay, racing, or other misuse of the golf cart will not be tolerated. Golf carts are to be operated on Breakfast Hill Golf Club cart paths and roadways only and not on thru sites or restricted areas. No off-road riding is allowed.
- Golf carts must remain within the allotted areas inside Breakfast Hill Golf Club.
- Golf carts can carry a maximum of two (2) people and passengers must be always seated when the golf cart is in motion. Feet/legs, arms, entire bodies must remain inside the golf cart.
- Any malfunctions or golf cart problems shall be reported to management immediately without further use of the golf cart.
- Any trash or personal items shall be removed from the golf cart prior to its return.
Anyone not adhering to the golf cart rules and regulations will forfeit all golf cart usage privileges. There will be no refunds made if the cart is returned because of operator misuse. Loss of security deposit will also result if the golf cart is misused or damaged.
I have no knowledge of any physical impairment that would affect or be affected by the undersigned operating a golf cart at Breakfast Hill Golf Club.
I understand that there may be further rules and regulations that must be followed. These further rules and regulations may be posted or orally related to the undersigned. I agree to abide by all rules and regulations and understand that failure to do so may result in my being removed from the premises.
I recognize and acknowledge that there are certain known and unknown risks of physical injury to people utilizing a golf cart, including but not limited to the following: golf cart rollover, collision with stationary objects, horseplay, negligent driving, being struck by flying objects, and falling out of golf carts. I voluntarily and fully choose to incur all such risks and dangers on behalf of myself.
I hereby fully and forever waive, release, and relinquish all claims, demands and actions whatsoever that I may have or may accrue to me against Breakfast Hill Golf Club, its officers, agents, volunteers, and employees arising out or in connection with the use of the golf cart.
I further agree to defend and indemnify Breakfast Hill Golf Club from any and all claims and actions resulting from injuries, damages, and losses sustained by me or any passenger, and arising out of, connected with, or in any way associated with the use of the golf cart, except to the extent any liability arises out of any willful and wanton act or omission of Breakfast Hill Golf Club.
No riding carts, scooters or bicycles, motorized or non-motorized, that are not available to rent at Breakfast Hill Golf Club are not allowed for use when playing golf.
